1. ARRIVAL & DEPARTURE
Arrival and departure times can be arranged individually with the landlord.
If the tenant does not arrive by 10 p.m. on the day of arrival, the contract shall be deemed terminated. The landlord or whose representative may then freely dispose of the property. A (proportional) refund of the rent due to No refunds will be given for early departure.
Upon receipt of the key, the tenant must pay a deposit of €50 per key in cash. The deposit will be returned at the end of the rental period upon proper return of the key.
The landlord reserves the right (after prior notification) to charge a deposit in cash for any damage, which must be paid by the tenant in cash upon arrival.
2. SPECIAL REQUESTS & ADDITIONAL AGREEMENTS
Special arrangements are possible in principle. They require written confirmation from the landlord. Pets are only permitted with the written consent of the landlord; the type and size must be specified in advance.
3. CONCLUSION OF CONTRACT & PAYMENT INFORMATION
A reservation is only confirmed once the booking confirmation has been issued and the deposit has been received. The deposit of 20% of the rental amount is due immediately upon booking. Payment is due. After the deposit has been paid, the balance must be paid no later than 30 days before arrival. Remaining amount of 80% due.
If the payment deadlines are not met, the landlord may withdraw from the contract. Non-payment shall be deemed withdrawal and the landlord or their representative may then dispose of the property as they see fit.
There are no additional charges for water and waste disposal.
4. WITHDRAWAL – CANCELLATION POLICY
The tenant may withdraw from the contract. Withdrawal must be made in writing. In the event of withdrawal by the tenant, the tenant shall be obliged to compensate for the damage incurred. If withdrawal occurs by
• 43 days before the start of the rental period, 20% of the room price is payable.
• From 42 days before the start of the rental period, 100% of the room price is payable.
In the event of cancellation less than 42 days prior to the start of the rental period, the full rental price shall be payable. The date of receipt of the cancellation notice shall apply. Any amounts already paid shall be credited.
The tenant may provide a replacement person who enters into the contract under the same conditions and pays the full rent on time. Written notification is sufficient. The landlord reserves the right to accept the replacement tenant.
5. OBLIGATIONS OF THE TENANT
The tenant undertakes to treat the rented premises (holiday home, inventory and outdoor facilities) with care and respect. If damage to the house, rooms and/or inventory occurs during the tenancy, the tenant is obliged to report this immediately to the landlord or property management.
Any defects or damage noticed upon arrival must be reported immediately to the landlord or property management company. Otherwise, the tenant will be liable for this damage. A reasonable period of time must be allowed for the repair of damage and defects.
Claims arising from complaints that are not reported immediately on site are excluded. Complaints that are only received by the landlord or property management company at the end of the stay or after leaving the rental property are also excluded from compensation.
In the event of any service disruptions, the tenant is obliged to do everything reasonable within the scope of their legal obligations to help remedy the disruption and minimise any damage that may have occurred.
On the day of departure, the tenant must remove all personal belongings, dispose of household waste in the designated bins, and return clean, washed dishes to the kitchen cupboards. Rooms must be left in a tidy and clean condition.
None of the furniture in the interior may be moved or taken outside or anywhere else. Rearranging the furniture is not permitted under any circumstances.
The storage of highly flammable or hazardous substances, such as fuels, explosives or similar, is strictly prohibited both inside and outside the rented premises.
We are a non-smoking establishment! Smoking is not permitted anywhere in the building. Smoking is only permitted on the terraces and in the garden area, and ashtrays must be used. If burn marks and/or holes occur, the tenant shall bear the repair or replacement costs.
6. DATA PROTECTION
The tenant agrees that necessary personal data may be stored, modified and/or deleted within the scope of the contract concluded with him. All personal data will be treated confidentially.
7. DISCLAIMER
The advertisement has been created to the best of our knowledge. We accept no liability for any impact on the rental property due to force majeure, power and water outages customary in the country, or severe weather. Likewise, we accept no liability in the event of unforeseeable or unavoidable circumstances, such as official orders, sudden construction work, or disruptions due to natural and local conditions. However, the landlord will assist in remedying the problems (as far as possible). The landlord is not liable for the use of the games and sports equipment provided.
The tenant is responsible for their own arrival and departure.
The landlord is not liable for personal belongings, including in the event of burglary, theft or fire. The tenant is fully liable for wilful destruction or damage. Likewise, the landlord accepts no liability for personal injury.
8. FINAL PROVISIONS
Photos and texts on the website and in the flyer are intended to provide a realistic description. We cannot guarantee that they will correspond 100% to the rental property. The landlord reserves the right to make changes to the furnishings (e.g. furniture).
Should one or more provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that most closely approximates the economic and legal intent of the contracting parties.
Spanish law applies.
